Thank you for considering to purchase from the Rushton's Deli website.

We would like to draw your attention to our terms of service as set out below. Our terms of service are designed to provide our customers with an efficient service that clearly defines our commitment to you and any contract between us. Please be aware that any purchases made through this website, or via telephone, are on the understanding that you have read, understood and accepted these terms of service.

RushtonDeli.co.uk & RushtonsHampers.co.uk are online trading names of Rushton's Delicatessen, 41 Stodman Street, Newark, Nottinghamshire, NG24 1AW, UK.

CONTRACT

No contract will exist between the customer and Rushton's until payment has been recieved and customer is informed that their order has been accepted. Confirmation that your payment has been taken is not confirmation that we have accepted your order. Such confirmation will be e-mailed to customer as soon as we have processed and agree to supply the goods / services in accordance with these terms of service. Rushton's reserves the right not to accept an order for any reason, and in such cases any payment made will be refunded in full. Any such refund will be made as quickly as possible and in no circumstances later than 30 days from the time of order.

PAYMENT

Most major credit & debit cards can be used to pay for goods and services provided by Rushton's including those offered through the website.

All payments are taken through a secure website encrypted with 128 bit SSL (Secure Socket Layer) encryption to ensure customers privacy and security. When ordering through websites operated by Rushton's, a highly reputeable third party (www.protx.com) is used for the collection of the credit & debit card information, ensuring the highest possible levels of security in our online ordering process. Rushton's do not collect or store your credit card details.

RETURNS / CANCELLATION

Non Damaged Goods

We hope that you, the customer, will be delighted with your prurchase, but if for any reason you choose to return the items to us you may do so by e-mailing us within 7 days from the receipt of your order. In such circumstances, please provide your name and order reference in your e-mail. We will then contact you via e-mail to inform you of the process required in returning the goods to us. During this time, it is your responsibility to look after the goods and maintain them in an unopened re-saleable condition - this includes the container in which goods were delivered.

If Rushton's collect the goods from you, we will refund you the difference between the price paid for the goods and the cost to us of collection of such goods. If you decide to return the goods at your cost, then we will refund the full amount paid for the goods - however, in this case it is the responsibility of you, the customer, to ensure that an efficient delivery/carrier service is used to return the goods with adequate insurance to cover you for damages that may occur in transit. Under no circumstaces will refunds be made if goods are recieved back by Rushton's in a damaged state.

Please note that any bespoke goods / services ordered by you including hampers that are made to your specific requirements are not included in this returns policy. Any orders that contain perisheable food items are also excluded

Damaged Goods

Should you recieve any damaged goods in your order, you must notify Rushton's via e-mail within 3 days of receipt of the order (please provide your name and order reference). We will work with you as quickly and efficiently as possible to either replace or refund the damaged items. Under such circumstances, Rushton's will re-imburse any postal costs incurred by you in returning damaged items.

DELIVERY

Where we can deliver

Rushton's use a courier service for delivery and can only accept orders directly for delivery to UK Mainland destinations through the RushtonsDeli.co.uk / RushtonsHampers.co.uk websites. We can accept orders for offshore UK and Northern Ireland destinations but a delivery surcharge will be required. In such circumstances we recommend that you telephone your order to Rushton's so that we can provide an accurate delivery cost. Rushton's can take your payment over the telephone for an order should you wish to proceed.

We do not currently deliver to any International destinations.

Delivery times.

Orders received and accepted prior to 2.00pm are usually processed and loaded onto our couriers vans same day, and in most cases will be delivered to you the next working day. However, we do not guarantee a next day service and advise customer that the majority of deliveries are completed within 2 working days. This timescale however may increase up to 4 working days for Scotish highlands and offshore locations.

A signature will be required on delivery. Should you not be able to check your goods immediately, please sign for them as 'unchecked'.

Please note that Rushton's cannot be held responsible for non delivery or delayed delivery due to insufficient or incorrect details submitted by the customer. To avoid any such problem, please make sure all contact telephone & address details are correct on order submission so that the carrier can contact you if the need arises.

If you are not at the delivery location at the time of order, the carrier will leave a card notifying you of an attempt to deliver your goods. Customer should contact the carrier directly to re-schedule delivery. Should you not be present at the second delivery attempt, or you fail to make contact with the carrier within 2 working days, the goods will be returned to Rushton's. In such circumstances customer will need to pay the costs of delivery again before the goods can be sent.

ORDERS THAT HAVE ALCOHOLIC CONTENT

Please note that under the Licensing Act 1964 it is an offence for someone under 18 to buy, or attempt to buy, intoxicating drinks, or for adults to buy or attempt to buy on their behalf. The maximum penalty is a fine of £1000. Some of the products offered for sale on this site contain intoxicating drinks. In accepting these terms and conditions, if you are purchasing products that contain intoxicating drinks, you are confirming that you are over the age of 18 and legally allowed to purchase alcoholic drinks and that they are not being sent to anyone under the age of 18.

SUBSTITUTIONS

We will always try to deliver your order, including hamper contents, as exactly described on our website. However, should a product become unavailable for any reason, Rushton's reserves the right to substitute such product with one of equal or greater price and quality. When possible, we will contact you prior to accepting your order to inform you of any substitution for your approval.

Circumstances beyond our control

While Rushton's will make every effort to fulfill orders with expediency, occasions may arise when this may not be possible due to circumstances beyond our control for example - but not limited to - Acts of God, Acts of Government, Fire, Flood, Labour Disputes, Lockouts, Drought, Strike or War, Explosion, Civil Disturbance, Technical failures with power transmission, telecommunications and information technology.

LAW AND INTERPRETATION

The contract shall be governed by English law and the buyer shall submit to the non exclusive jurisdiction of the English courts. If any of these conditions or any part thereof is to be rendered void or unenforceable by any legislation to which it is subject or by any rule of law it shall be void or unenforceable to that extent and no further.
